Sexual Performance By A Child
Chapter 43 of the Texas Penal Code defines charges and punishments for offenses of public indecency.
“Sexual Performance by a Child,” as per § 43.25 of the Texas Penal Code, occurs when a person, knowing the character and content thereof, employs, authorizes, or induces a child younger than 18 years of age to engage in sexual conduct or a sexual performance. A parent or legal guardian or custodian of a child younger than 18 years of age commits an offense if they consent to the participation by the child in a sexual performance.
An offense under this subsection is a felony of the second degree, except that the offense is a felony of the first degree if the victim is younger than 14 years of age at the time the offense is committed, regardless of whether the actor knows the age of the victim at the time of the offense.
Additionally, a person commits an offense if, knowing the character and content of the material, they produce, direct, or promote a performance that includes sexual conduct by a child younger than 18 years of age.
An offense under this subsection is a felony of the third degree, except that the offense is a felony of the second degree if the victim is younger than 14 years of age at the time the offense is committed, regardless of whether the actor knows the age of the victim at the time of the offense.

Third Degree Felony
Imprisonment in the institutional division for not more than 10 years or less than two years
In addition to imprisonment, may receive a fine not to exceed $10,000
Second Degree Felony
Imprisonment in the institutional division for not more than 20 years or less than two years
Additionally, a person commits an offense if, knowing the character and content of the material, he produces, directs, or promotes a performance that includes sexual conduct by a child younger than 18 years of age.
An offense this under Subsection is a felony of the third degree, except that the offense is a felony of the second degree if the victim is younger than 14 years of age at the time the offense is committed, regardless of whether the actor knows the age of the victim at the time of the offense.
