Voyeurism

Chapter 21 of the Texas Penal Code sets restrictions and guidelines regarding sexually based offenses in the state of Texas.

“Voyeurism”, as per § 21.17 of the Texas Penal Code, occurs when a person, with the intent to arouse or gratify the sexual desire of the actor, observes another person without the other person's consent while the other person is in a dwelling or structure in which the other person has a reasonable expectation of privacy.

Voyeurism is a Class C misdemeanor, punishable by a fine of up to $500, unless:

The defendant has been convicted of the offense two or more times (Class B misdemeanor)

The victim was a child younger than 14 years of age at the time of the offense (State Jail Felony).

Misdemeanor B

Confinement in jail for a term not to exceed 180 days

Fine not to exceed $2,000

State Jail Felony

Confinement in a state jail for not more than two years and not less than 180 days

In addition to confinement, may receive a fine not to exceed $10,000
